Please read these Terms & Conditions (“Terms“) carefully before accessing or purchasing through our Site. By accessing, browsing, or purchasing from our platform, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree, you must discontinue use of the Site immediately.

1. General Overview & Agreement to Terms

Governing Law: These Terms are governed by and construed in accordance with the laws of Australia and the state/territory in which we operate.
Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any consumer rights, guarantees, or remedies conferred upon you by the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL) that cannot be lawfully excluded.
Modifications: We reserve the right to revise or update these Terms at any time. Changes take effect upon posting to the Site. Your continued use of the Site signifies acceptance of the updated Terms.

2. Eligibility & Account Security

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to make purchases on this Site.
When creating an account, you agree to provide accurate, current, and complete details. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

3. Products, Pricing & Accuracy

Factory-Direct Inventory & Pricing: All prices are displayed in Australian Dollars (AUD) unless another currency is selected. Prices include Australian Goods and Services Tax (GST) where applicable. For international orders, local import duties, customs taxes, or clearance fees may apply and remain the sole responsibility of the purchaser.
Pricing & Typographical Errors: We strive for absolute accuracy in grading specifications, carat weights, and pricing. In the rare event an item is erroneously listed at an incorrect price or with inaccurate gemmological details due to technical or typographical error, we reserve the right to cancel or decline the affected order prior to shipment and issue a full refund.
Visual Representation: Diamonds and fine jewellery are displayed using high-resolution macro photography and 360-degree interactive viewers. Variations in screen calibration, monitor settings, and ambient lighting may slightly alter visual perception. Official physical dimensions, carat weight, and grading parameters are governed by the accompanying laboratory certification.

4. Certification & Independent Grading

Certified diamonds are accompanied by independent grading reports from accredited international gemmological institutions (such as IGI, GIA, or equivalent).
Each digital certificate and physical report constitutes an independent expert appraisal and grading opinion. Physical certificate replacements may incur third-party laboratory reissue fees if lost by the customer.

5. Orders, Payment & Verification

Order Acceptance: Receiving an order confirmation email indicates receipt of your request; it does not constitute a legally binding acceptance. We reserve the right to decline or cancel any order for reasons including non-authorization of payment, suspected fraudulent activity, or unforeseen material shortages.
Payment Processing: All transactions are processed through encrypted, PCI-DSS-compliant payment providers (e.g., credit cards, debit cards, direct bank wire, or approved installment providers). Full payment authorization must be completed before an item is manufactured, resized, or dispatched.
Anti-Fraud Security: High-value diamond orders may require identity verification or fraud prevention checks prior to release. We reserve the right to cancel unverified transactions.

6. Custom & Bespoke Commissions

Definition: Custom designs, bespoke settings, personalized engravings, and non-standard ring resizings ordered specifically for a client are classified as Made-to-Order / Custom Goods.
Production Timeline: Custom pieces undergo individual bench manufacturing and strict quality checks. Estimated lead times are provided in good faith and may vary during peak seasons or complex stone-setting stages.
Cancellations & Adjustments: Once production or stone cutting/mounting has commenced on a custom piece, changes or cancellations may incur restocking and bench labor charges.

7. Shipping, Delivery & Transit Insurance

Insured Shipping: We ship domestically across Australia and to over 50 global destinations via secure, trackable express courier services (e.g., Australia Post Express, FedEx, DHL). High-value parcels are fully insured until handed over.
Signature Required: For your security, all deliveries strictly require an adult signature upon delivery. Couriers will not leave parcels unattended (no “Authority to Leave”).
Risk of Loss: Risk of loss and title for items pass to you upon delivery and signature confirmation at the designated shipping address.

8. Returns, Exchanges & Change of Mind

Australian Consumer Law Compliance: If a product exhibits a major failure, manufacturing defect, or fails to meet mandatory statutory guarantees under the ACL, you are entitled to a replacement, repair, or full refund as prescribed by law.
Standard Inventory Returns: For standard, non-customized pieces, we offer a specified return or exchange window (e.g., 30 days from delivery) provided the item is returned in brand-new, unworn condition, in its original packaging, and with all security tags and original laboratory certificates intact.
Custom & Engraved Pieces: Consistent with the ACL, made-to-order bespoke jewelry, personalized engraved rings, and stones customized to individual client specifications are exempt from change-of-mind returns.

9. Manufacturing Warranty & Care

Craftsmanship Guarantee: We stand firmly behind the structural integrity of our pieces and offer a warranty against manufacturing defects from the date of purchase.
Warranty Exclusions: Our warranty does not cover damage resulting from everyday wear and tear, trauma, accidental loss, improper cleaning, or work/resizing conducted by third-party jewelers not authorized by Stella Nova Diamonds.

10. Intellectual Property Rights

All content on this Site—including diamond renders, brand names, visual assets, software, logos, text, and jewelry designs—is the exclusive intellectual property of Stella Nova Diamonds or our licensors and is protected by Australian and international copyright and trademark laws. Unauthorized reproduction or commercial use is strictly prohibited.

11. Limitation of Liability

To the maximum extent permitted by law:

Stella Nova Diamonds is not liable for indirect, incidental, or consequential losses arising out of the purchase, delivery, or use of any product.
Our total liability for any verified claim arising out of these Terms or your purchase will not exceed the total amount paid by you for the specific item giving rise to the dispute.
